PAYMENT AUTHORIZATION

General Authorization

You authorize us to process the transactions permitted under this Agreement for you as requested by you from time to time, and you authorize us to post transactions to your account(s) as directed. You may request a payment be delivered one time, or on an automatic recurring basis in such manner as you direct.

By signing below, you authorize TruNorth systems and its service providers to process transactions and instructions and to post transactions to your account(s) as directed. You further authorize TruNorth systems to make automatic recurring payments in such manner as you direct. TruNorth systems's receipt of your payment instructions authorizes us, or our service providers, to debit or charge (or if the Payment Account is with another financial institution, request that such institution debit) your Payment Account, and to remit (or request that such financial institution remit) funds on your behalf.

You understand that this authorization will remain in effect until you cancel it in writing, and you agree to notify TruNorth systems in writing of any changes in your account information or termination of this authorization at least 15 days prior to the next billing date. If any scheduled payment dates fall on a weekend or holiday, you understand that the payments may be executed on the next business day. You certify that you are an authorized user on the payment account and will not dispute any scheduled transactions with your bank or credit card company.

Electronic Communication

You agree that all electronic communications will be given the same legal effect as your written and signed paper communications and shall be considered a writing or in writing. They also shall be deemed for to have been signed and to constitute an original when printed from electronic files or records established and maintained in the normal course of business.

You agree that electronic copies of communications are valid and you will not contest the validity or enforceability of such communications or any related transactions, absent proof of altered data or tampering, under the provisions of any applicable law relating to whether certain agreements are required to be in writing or signed by the party to be bound thereby, and such copies shall be admissible as evidence in any judicial, arbitration, mediation, or administrative proceeding to the same extent and under the same conditions as other business records originated and maintained in paper form.

You agree to receive all transactional email communications from us that are primarily related to your account(s), including automatic alerts. You consent to any inadvertent disclosures that may occur as a result of us sending account communications to the email address attached to your account.

It is your responsibility to provide us with a true, accurate and complete email address and other contact information, and to promptly provide us with any updates to your contact information. Hardware and Software Requirements

In order to access, view and retain electronic communications that we make available to you, you must have the following:

Communications in Writing

All communications that we send to you in either electronic or paper format will be considered to be communications in writing, and you should print or download copies of all such communications for your personal records.

Federal Law

You further acknowledge and agree that your consent to electronic communications is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act (E-Sign Act – 15 U.S.C. §§ 7001 – 7006), and that the E-Sign Act shall apply to the fullest extent possible to validate our ability to conduct business with you via electronic communications.

Payment in Full

Because your credit agreement may require you to pay interest on the outstanding portion of your balance, as well as late charges and costs of recovery, which vary from day to day, as you agreed in your credit agreement, the amount required to pay your account in full on the day you send payment may be greater than the amounts that appear in our written communications. If an amount is stated on a letter and you pay that amount, an adjustment may be necessary after we receive your payment. In that event, we will notify you of any adjustment in your balance. We encourage you to call prior to making a payment intended to pay your account in full.

Email Communications

By emailing TruNorth systems, you are requesting to receive email from TruNorth systems on an ongoing basis. By emailing and/or providing your telephone number you are giving express consent to call and/or reply to your personal email. Your response also provides assurance that the email address provided is secure to your use. You may need Adobe Acrobat Reader to access some of the electronic records that may be sent to you.

Confidentiality Notice for Email

All email communications, including any attachments, are covered by the Electronic Communication Privacy Act of 1986 (18 U.S.C. sections 2510-22) and may contain information protected by the federal regulations under the Health Insurance Portability and Accountability Act of 1996 (45 C.F.R Parts 160-164) or other confidential information. If you are not the intended recipient (or authorized to receive for the recipient), you are hereby notified that any review, disclosure, dissemination, distribution or copying of the communication is strictly prohibited. If you have received the communication in error, please delete and/or destroy all copies of the communication and any attachments. No confidentiality or privilege is waived by errant delivery. Email transmissions cannot be guaranteed to be error-free as information could be intercepted, corrupted, lost, destroyed, arrive late, incomplete, or contain viruses. Therefore, the sender, TruNorth systems does not accept liability for any errors or omissions in the contents of the message.



State Specific Notices

California Residents

The state Rosenthal Fair Debt Collection Practices Act and the federal Fair Debt Collection Practices Act require that, except under unusual circumstances, collectors may not contact you before 8 a.m. or after 9 p.m. They may not harass you by using threats of violence or arrest or by using obscene language. Collectors may not use false or misleading statements or call you at work if they know or have reason to know that you may not receive personal calls at work. For the most part, collectors may not tell another person, other than your attorney or spouse, about your debt. Collectors may contact another person to confirm your location or enforce a judgment. As required by law, you are hereby notified that a negative credit report reflecting upon your credit record may be submitted to a credit reporting agency if you fail to fulfill the terms of your credit obligations.

Colorado Residents

FOR INFORMATION ABOUT THE COLORADO FAIR DEBT COLLECTION PRACTICES ACT, SEE WWW.COAG.GOV/CAR. A consumer has the right to request in writing that a debt collector or collection agency cease further communication with the consumer. A written request to cease communication will not prohibit the debt collector or collection agency from taking any other action authorized by law to collect the debt. Massachusetts Residents

NOTICE OF IMPORTANT RIGHTS: You have the right to make a written or oral request that telephone calls regarding your debt not be made to you at your place of employment. Any such oral request will be valid for only ten days unless you provide written confirmation of the request postmarked or delivered within seven days of such request. You may terminate this request by writing to the collection agency.

New York Residents

If a creditor or debt collector receives a money judgment against you in court, state and federal laws may prevent the following types of income from being taken to pay the debt: supplemental security income, (SSI), social security, public assistance (welfare), spousal support, child support, unemployment benefits, disability benefits, workers’ compensation benefits, public or private pensions, veterans’ benefits, federal student loans, federal student grants, federal work study funds, and ninety percent of your wages or salary earned in the last sixty days.

North Carolina Residents
